All data subjects whose personal data is collected, in line with the requirements of the General Data Protection Regulation.

Leather Taylor Ltd is responsible for ensuring that this notice is made available to data subjects prior to Leather Taylor Ltd collecting/processing their personal data. We do this by making this policy and notice available online and in our offices.
Leather Taylor Ltd employees who process data and interact with data subjects will, where suitable, ensure that this notice is drawn to the data subject’s attention and, where required, secure their consent to the processing of their data.

4 Privacy notice
4.1 Who are we?

4.2 Data Collection and Use of Data
Personal data is any information which identifies you personally whether directly (for example, your name) or indirectly (for example, information about your use of our products and services).
We may collect the following data about you:

•  The personal data we may collect will be used for the following purposes:
• For the fulfilment of your funeral service, or other requested service, including, where required;
• the selection and engagement of a religious minister or life celebrant
• provision of funeral cars to selected addresses
• collection and forwarding of donations to selected charities and provision for the sending of receipts\acknowledgements
• providing list of ‘in memory’ donors to families
• invoicing, payment collection and payment processing
• referral to decisions made in previous historical funeral arrangements
• recording of instructor and instructions regarding the disposal or collection of cremated remains

As a burial authority for Fernhill Park Woodland Burial Ground

• recording a list of the holders of the exclusive right of burial.
• recording burials that have taken place.

When acting as a data processor for prepaid funeral plan providers

• the checking correctness and forwarding of prepaid funeral plan applications to plan providers on behalf of the applicant.
• once the plan has been accepted, we maintain a list of accepted plans that have been allocated to us for reference at the time of need. We do not use this information for non-related purposes.

Recruitment

• If you are applying for a role with us then we collect and use this personal data for recruitment purposes – in particular, to determine your suitability for a specific role. This includes assessing your skills, qualifications and verifying your information, carrying out reference checks or background checks (where necessary) and to generally manage the hiring process and communicate with you about it. If you are accepted for a role with us, the data collected during the recruitment process will form part of your ongoing employee record.

Respond to enquiries, complaints and disputes

• We process your data to allow us to provide and personalise our services, answer your requests, enquiries, complaints and provide information on the services that we provide.

Conduct Surveys

• Information from surveys that we use for research purposes (if you choose to respond to them) for improving our products and services and our Site.

• Online order fulfillment

We or our third-party providers will collect transaction details relating to transactions you carry out through our Site for the purposes of fulfilling your orders.

• Details of visits to Sites

Details of your visits to our Site, including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

• To send you service communications, including in relation to changes to our Trading Terms or Terms of Trading

We may use the contact details you have provided to us so that we can communicate with you about the products and services that we provide, including to let you know about major changes to those products and services or to the Trading Terms or Terms of Trading between us or to any related information.

• Direct marketing (including by third parties)

If you have provided your consent or we otherwise have the right to do so, we may use your contact details to send you direct marketing and keep you informed of promotional offers by email, SMS, post or telephone relating to our products and services. You can unsubscribe from our direct marketing at any time by clicking the “Unsubscribe” link in any of our emails or by contacting us.

• Maintain our records and improve data accuracy

We will use your data to keep our records as accurate and up to date as possible.

Our legal basis for processing your personal data:

• fulfilment of a contract – regarding the funeral provision, invoicing and payment collection as per our Terms and Conditions. If we are unable to collect all of the data necessary, our ability to provide our products and services to you may be affected.
• legitimate interests of the bereaved families, charities and donors – regarding the management of donations
• legal obligations and fulfillment of a contract – regarding the management of burial sites
• legitimate interests of the prepaid funeral plan applicant and plan provider – regarding helping complete the applicant’s application form.
• consent – regarding any direct marketing regarding of our products and services that we undertake.

Any legitimate interests pursued by us, or third parties we use, are as follows:

• forwarding of donor names to bereaved families on behalf of donors. Anonymous donations can be made
• forwarding of next of kin contact details to charities for the purpose of acknowledging donations in memory
• completion of funeral plan application forms on behalf of applicant and funeral plan providers
• use of your personal data to ensure that we can; personalise our products and services for you, personalise our contact with you, comply with contractual obligations to you and third parties, provide staff training, carry out effective management and administration of our business, compliance with legal obligations, defend legal claims and respond you enquiries you have made.

Where we think there is a risk that one of your interests or fundamental rights and freedoms may be affected we will not process your personal data unless there is another legal ground for us to do so (either that we have obtained your consent to the processing or it is necessary for us to perform our contract with you or to comply with our legal obligations).

The special categories of personal data concerned are:

• None. However, when completing a prepaid funeral plan application, the applicant may specify a religious denomination on the application form. This data item is not compulsory and is used purely for the benefit of recording the applicants wishes to help the next of kin. Such information can be changed or deleted at any time by contacting the funeral plan provider. Leather Taylor Ltd do not retain any information regarding the funeral plan application but may receive data from the plan provider if the application is accepted. Leather Taylor Ltd is then a data processor to this data and is bound by the requirements of the plan provider (as the data controller).

4.3 Consent
By consenting to this privacy notice you are giving us permission to process your personal data specifically for the purposes identified.
You may withdraw consent at any time by contacting us to update your preferences.

4.4 Disclosure
Generally, we may provide your personal data to our suppliers and service providers, including other companies in our group, who provide certain business services for us and act as “processors” of your personal data on our behalf. In addition, we may disclose your personal data if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to protect the rights, property, or safety, of our business, our customers or others. This includes, in specific cases, exchanging information with other organisations for the purposes of fraud protection.

In some cases, the personal data we collect from you may, for the purposes set out above, be transferred outside the European Economic Area (EEA) and such destinations may not have laws which protect your personal data to the same extent as in the EEA. We are required by data protection law to ensure that where we or our “processors” transfer your personal data outside of the EEA, it is treated securely and is protected against unauthorised access, loss or destruction, unlawful processing and any processing which is inconsistent with the purposes set out in this Privacy Policy.

Specifically, the following third parties may receive your personal data for the following purpose(s):

• A crematorium for the purpose of allowing and organising the cremation of the deceased.
• A cemetery/burial authority for the purpose of allowing and organising the burial of the deceased.
• A nominated celebrant/minister for the purpose of arranging details of the funeral service.
• Nominated charity or charities for the purpose of acknowledging donations in memory.
• Other funeral directors that may be involved in the arrangements, as necessary.
• Third party organisations that may help us with regard to payment collection and other functions related to the performance of the contract.

4.5 Retention period
Leather Taylor Ltd retain your personal data for no longer than is necessary for the purposes(s) for which it was provided. What this means in practice will vary between different types of data. When determining the relevant retention periods, we take into account factors including:

• customer expectations
• legal obligation(s) under applicable law to retain data for a certain period of time;
• statute of limitations under applicable law;
• potential or actual disputes; and
• guidelines issued by relevant data protection authorities.
• Otherwise, we securely erase your personal data from our systems when it is no longer needed.
• Specifically, Leather Taylor Ltd will process personal data for as long as is necessary to allow us to fulfil your funeral service and possible future needs and will store the personal data as follows;
• Funeral Arrangement details, indefinitely
• Because families often reply on our records when referring to previous family funerals.
  Donations, seven years after the date of the funeral.
• Because we may be asked to verify charitable donations for tax or other reasons.
  Cremated remains register, indefinitely
• Because we are often asked what has happened to a family member’s cremated remains.
  Burial authority register, indefinitely
• Because as a burial authority, we are required to keep a register of burials and ‘exclusive right of burial grant holders’ at Fernhill Park Woodland Burial Ground.

4.6 Security

• Your data is stored in locked and alarmed offices. Where data is stored digitally, the computers are kept up-to-date, password protected and include up-to-date antivirus\malware software.
• Data is backed up regularly and password protected.

5 Your rights as a data subject
At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

• Right to be informed – You have the right to be provided with clear, transparent and easily understandable information about how we use your personal data and your rights.
• Right of access – you have the right to request a copy of the information that we hold about you.
• Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
• Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
• Right to restriction of processing – where certain conditions apply to have a right to restrict the processing.
• Right of portability – you have the right to have the data we hold about you transferred to another organisation.
• Right to object – you have the right to object to certain types of processing such as direct marketing.
• Right to object to automated processing, including profiling – you also have the right to be subject to the legal effects of automated processing or profiling.
• Right to judicial review: in the event that Leather Taylor Ltd refuses your request under rights of access, we will provide you with a reason as to why. You have the right to complain as outlined in clause 5. below.
• All of the above requests will be forwarded on should there be a third party involved (as stated in 3.4 above) in the processing of your personal data.

In the event that you wish to know more about how Leather Taylor Ltd uses your data, or to make a complaint about how your personal data is being processed by Leather Taylor Ltd (or third parties as described in 4.4 above), or how your complaint has been handled, you have the right to lodge a complaint directly with the supervisory authority and Leather Taylor Ltd.

Why does Leather Taylor Ltd need to collect and store personal data?
In order for us to provide you with a funeral service we need to collect personal data for fulfilment of the contract and any related correspondence. In any event, we are committed to ensuring that the information we collect and use is appropriate for this purpose, and does not constitute an invasion of your privacy.

In terms of being contacted for marketing purposes Leather Taylor Ltd would contact you for separate consent.

Will Leather Taylor Ltd share my personal data with anyone else?
We may pass your personal data on to third-party service providers contracted to Leather Taylor Ltd in the course of dealing with you. Any third parties that we may share your data with are obliged to keep your details securely, and to use them only to fulfil the service they provide on behalf of Leather Taylor Ltd. When they no longer need your data to fulfil this service, they will dispose of the details in line with Leather Taylor Ltd’s procedures.
